DURC certification and access to social contribution benefits: new audit
procedures
With
message no. 3220 of August 3, 2017, INPS determined that, from
September 1st onwards, new procedures for the preliminary audits
necessary for the application of social contribution benefits and the
release of the so-called “internal” DURC certification will
be operational.
Specifically, the audit procedure:
- will automatically insert in the “Durc online” portal the audit request of any authorized subject;
- will be activated for all Uniemens data submissions for which a preliminary notice if irregularity has been submitted.

Occasional
work: instructions from the Ministry of Labor
Together
with new regulations on occasional work, the Ministry of Labor provided
clarifications on possible fines in case of violation of related
provisions.
The Ministry considers the following circumstances:
- exceeding the limit of hours or compensation;
- using the occasional work of a subject with whom the user has, or had in the prior 6 months, a subordinate employment relationship or a “co.co.co.” collaboration;
- violation of communication obligations and of the prohibition to use such contracts by companies who have more than 5 subordinate employees with a permanent contract;
- violation of further obligations..
The Ministry considers the following circumstances:

Complementary pension funds: new regulations
Complementary
pension funds are now more flexible and convenient. The law upon market
and competition for 2017 has introduced new regulations on pension
funds, aimed at increasing access possibilities.
Said law, effective since August 29th, 2017, applies changes upon:
- Choice of the percentage of TFR to be devolved to pension funds;
- Facilitations on advance pension payment;
- Redeeming procedures for individual positions;
- RITA early pension treatment.

Priority
in case of new hires for fixed-term and apprenticeship contracts
The Ministry of Labor has provided clarifications upon the correct
interpretation of art. 24, c. 1, Legislative Decree no. 81/2015, upon the right
of priority granted to fixed-term employees in case of new hires with a
permanent contract.
The Ministry states that
both the prosecution of the apprentice’s employment relationship after the period
of training and the new hire of an apprentice do not constitute a violation of
said right of priority.
