Legislative Decree 10 September 2018, no. 101 introduced, in the attempt to adjust Italian law to European regulations upon the treatment of personal data (GDPR), new offence cases, adjusting – effective on 19 September 2018 – the sanction framework of Legislative Decree 30 June 2003, no. 196.

Collective dismissal: effects of omissions and imprecisions in the advance notification

A recent orientation in case law states that omissions or imprecisions in data specified in the advance notification to trade unions for a collective dismissal procedure may cause the unlawfulness of the procedure itself only when they’re relevant enough to cause a false or incomplete representation of reality, limiting the trade union’s rightful audit.
